WHAT TO EXPECT
Realtors in New Jersey, adhere to the standards and requirements set by the National
Association of Realtors (NAR) and local real estate regulations. One critical aspect of these
standards involves the formal agreements between buyer agents and their clients. Below is an
outline of the tasks I perform from the beginning of our client relationship through closing,
When we meet I will explain the types of agreements commonly used per NAR guidelines and
your options. As of August 2024, nationwide, Realtors will be required to have a signed Buyer Agency
agreement defining roles and fees, before showing any property.
Initial Consultation:
Understanding Your Needs: After listening to your goals, preferences, timing, and readiness, we will discuss the process ahead. I will explain the Buyer Agency Agreement and the full range of services. We will discuss how I work to ensure every advantage during an often complicated process. We will discuss your financial options for purchasing and what will be needed. Committed to helping you reach your goals, and guiding you every step of the way, we will discuss communication preferences. As we review the Buyer Agency agreement and discuss options tailored to your needs, you will have clarity from the start. With the required written agreement, as my client, I will be authorized to work as your trusted real estate advisor to help guide and protect you. I also will become authorized to show you properties. From this point on, you can count on my help and expertise every step of the way. To begin, I will provide blank copies of documents and also explain what you will need to have in place to be prepared for a strong offer.
Home Search and Showings:
As your Buyer Agent, I will expand the search to include Exclusive Listings not yet online. (An Exclusive Listing is a company-only listing NOT publicized) I will arrange for listing alerts to be sent to you daily so that you will not miss an opportunity. With Coldwell Banker Realty's advanced technology and extensive network of thousands of Agents, I receive notifications of new listings often before hitting the market.
In today's market, it is important to view a property as soon as possible after it hits the market and be prepared to make a quick decision. Many homes have multiple offers within a few days. I streamline the process of scheduling and coordinating property viewings, ensuring we make the most of your time and opportunities. Open houses are hosted by the Seller's Agents, committed ONLY to their client's best interest, not yours. Sign in with YOUR Agent representative when attending open houses and let me know what you think and if you want to make an offer, I will begin the process by preparing a market analysis of that property to help determine value, Then, the critical offer stage begins.
Making an Offer:
When you find a home you're interested in, we will discuss the price, terms, and closing date to be included in the contract. Knowledgeable and educated, I will prepare the documents for your offer, of which several are required for a purchase offer in New Jersey. The following is a summary of documents for your offer, which would become the purchase agreement if accepted. I will explain and guide you to further understanding when needed.
Purchase Agreement: This is the main document that outlines the terms of your offer, including the purchase price, down payment, inspection dates, deposits, and any contingencies such as financing.
Documents:
Purchase agreement: This will include price, terms, legal terms, closing date, mortgage amount, data of deposits, dates of inspections, etc.
Statement of Disclosure: This document clarifies the Agency and services that assist Coldwell Banker Realty.
Dual Agency: Agreement if the property is represented by a Coldwell Banker Realty agent.
Lead Paint: Discloses owner doc if property was built before 1978.
Flooding: : stating info about the property.
Septic agreement if needed.
Pool agreement if needed.
Proof of Funds or Pre-approval Letter: Accompanying the offer, this document confirms qualification from the lender for a mortgage.
Fees: As of Augues 17, 2024, a document will be required stating Buyer and Seller compensation.
Offer Accepted! Now What?
The Attorney Review Period begins the day after all parties have signed.
Once both parties sign the contract, it becomes legally binding subject to the completion of the attorney review in New Jersey. It is common practice that both the Sellers and Buyers hire an attorney to review the contract and be the legal advisor. This period typically lasts three business days but can be extended. During this timeframe, either party can withdraw from the agreement. Attorneys may propose changes to the legal content of the contract to benefit their clients.I will be in close contact with your attorney throughout this period. During this timeframe, my role is to ensure that communication between all parties is clear and that adjustments to the real estate contract are properly understood and agreed upon. Seller and Buyer Agents communicate with each other on behalf of their clients to assist all parties to have a smooth transaction.
The attorney Review Period is a safeguard that reflects the complexity and significance of real estate transactions, ensuring that all legal aspects are correctly addressed. This
period allows you to have peace of mind knowing that a legal professional has reviewed and approved the terms of your home purchase. Your attorney and I will work together to protect your interests and help secure your new home. However, I will ensure that any necessary
adjustments to the contract are made promptly and efficiently. Once both attorneys finish and agree, you and the Sellers will be in a binding agreement or what we call Under Contract. The property can no longer be shown or marketed.
Under Contract:
It will be time to schedule your home inspections and apply if you are getting a mortgage.
Contingency Management: I oversee the inspection process and manage any other
contingencies, addressing any issues that may arise. Contract deadlines must be met along the way and the first will be your deposit.
I will schedule your home inspection with the homeowner and will attend with you. Your attorney will review the report with you and send any repair requests to the seller's attorney. The inspection contingency will be satisfied when all parties agree. With Coldwell Banker's comprehensive support team, I manage all contingencies with precision and diligence, ensuring a smooth transaction, and minimizing any potential issues or delays.
Closing:
Closing Preparation: My Coldwell Banker Realty's robust network of professionals and partners ensures a seamless closing process, coordinating all aspects and ensuring everything is in place for a successful closing. You will need to contact utility companies a few days before closing.
Final Walk-Through: I will arrange a final walk-through of the property, and help address any last-minute concerns before closing. This is usually on the day of closing or the day before.
The DAY IS HERE! I will attend the closing with you, ensuring that everything is in order, addressing any last-minute concerns, and providing any assistance you may need. In New Jersey, a title company Closing Agent, selected by your attorney, will meet with us and handle the closing. Handover of Keys: After closing, I facilitate the smooth transfer of keys and will offer any additional support or resources you may need as you settle into your new home.
Post-Closing:
Follow-Up: Even after closing, I remain committed to your satisfaction and success,
